GARNET HOMES — AGENT TERMS & CONDITIONS
1. Introduction
These Terms & Conditions govern your use of the Garnet Homes EOI Agent Portal ("the Portal") as a registered agent. By accessing the Portal or submitting an Expression of Interest ("EOI") through it, you agree to be bound by these Terms.
2. Your Account
Your login is provided to you by Garnet Homes, either through the Portal's invitation process or set up directly based on our discussions with you. You are responsible for keeping your login details confidential and must not share your account with anyone else. You must notify Garnet Homes immediately if you believe your account has been accessed without authorisation. Garnet Homes may suspend or deactivate your account at any time, including if you no longer represent an agency working with Garnet Homes, or if we reasonably believe these Terms have been breached.
3. Your Role
The Portal allows you to capture a prospective client's preferences and generate a tentative cost estimate on their behalf, which is then submitted to Garnet Homes as a formal Expression of Interest. You are acting as a representative in this process — you are not an employee or agent of Garnet Homes, and nothing in these Terms creates an employment, partnership, or agency relationship between you and Garnet Homes.
4. Client Consent & Accuracy
Before submitting an EOI, you must have your client's consent to share their name, contact details, and stated preferences with Garnet Homes for this purpose. You are responsible for the accuracy of the information you enter — Garnet Homes relies on you to submit information that genuinely reflects what your client has told you.
5. Estimates Are Not Binding
Any price, cost estimate, or total shown in the Portal is a draft estimate only. It does not constitute a quote, offer, or binding contract of any kind. Final pricing is only confirmed once Garnet Homes has discussed the client's full requirements and prepared a formal, fixed-price tender.
6. Tender Fee
Where a tender fee applies, it is a fee payable directly by the client to Garnet Homes to secure preparation of a formal tender. Your role is to relay this information accurately to your client — you must not collect this fee yourself or represent that you are collecting it on Garnet Homes' behalf.
7. Acceptable Use
You must not use the Portal to submit false, misleading, or fictitious information, attempt to access another agent's account or another builder's data, or use the Portal for any purpose other than genuinely representing a prospective client to Garnet Homes.
8. Confidentiality
Floor plans, pricing, inclusion packages, and other business information shown in the Portal are provided to you solely to assist you in representing Garnet Homes to your clients. You must not copy, share, or use this information for any other purpose, including representing it as belonging to another builder.
9. No Warranty
The Portal is provided "as is." Garnet Homes does not guarantee it will be available at all times or free from errors, and is not liable for any loss arising from your reliance on a draft estimate that is later revised.
10. Changes to These Terms
Garnet Homes may update these Terms from time to time. Continued use of the Portal after an update means you accept the revised Terms.
11. Termination
Garnet Homes may end your access to the Portal at any time, with or without notice, including where your relationship with Garnet Homes or the agency you represent has ended.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
